They probably can't. I assume we'll hear about Blizzard opening a lawsuit against them within the next couple days.
As someone that works in retail, I know for a fact that laydown dates are very strict. ESPECIALLY for a release as anticipated as this. Usually (but not always) retail companies enter into contract before they're sent any copies. Some places don't have to sign these contracts to receive the merchandise though (this is how Walmart was able to sell early copies of Harry Potter 7 without getting sued).
