Freeing inactive character name question

So I've decided to come back to WoW after a half year break, and I have moved overseas since then. I'm going to transfer my main to a new realm, but their name is already taken on that realm. The owner of the character on that realm happens to be a friend of mine, he never really played that character in a long time, his account has been inactive for about a year, and he told me he isn't going to play again.
I heard that sending a ticket to a GM can enable you to having the name, given the other character has been inactive long enough. The character is level 58, which could be a problem, as the chances of getting the name freed lessen depending on their level. So if I were to send a ticket, what are my chances? And another question, if they remove the name on his character will it stick to his account for 30 days as it does when you delete a character? Or will I be able to take the name instantly?

Hi Squeaky,
Although account activity is one of the criteria that the Game Masters look at when such a request is put to us, it is not the only criteria that we consider. Although I won't be able to go into specific detail about what we look at, you're welcome to submit the ticket to us with the name and realm of the character in question. Thanks!
